Se trata de un análisis a los institutos de menores y a través de ellos a la concepción que el Estado tiene sobre la niñez en Argentina, al supuesto amparo de la Convención Internacional de los Derechos del Niño, más precisamente al de uno de sus principios rectores: el “interés superior del niño”. Para ello se analiza a la “Fundación Felices los Niños”, institución religiosa de gestión privada con subsidio estatal, cuyo destinatario, según sus objetivos, “es el chico de la calle, el que está en situación de abandono material o moral”.

El caso analizado nos permite abordar, a la luz de la Convención, cuál es el “interés superior” que tiene en cuenta el juez de menores al aplicar medidas socio correctivas (como la internación del niño, en macroinstitutos) lo que significa la pérdida de su familia, su individualidad, sus afectos. La institucionalización, tal como lo plantea la CIDN, debe ser “el último recurso” ya que aquella considera al niño como un número, un ser dependiente y dificulta su reinserción familiar y social.

 

ABSTRACT

It’s analysis on the minor institutes, and through them to the conception that the state has about the argentinian childhood, to the supposed protection from the International Children Convention most precisely, to the principle of the “superior child’s interest”. For that save, “The happy children foundation” is analyzed, religious institution of private character with statal benefit, destined to the left street children.

The prior case allows us to understand, which the superior interest taken into account by the judge, when the applies social corrective measures, for example the internment of the child into the macroinstitute resulting in the loss of the family the loss of his affection and individuality. The institutional as this once is showed by the CIDN, must be the last resource, because that consider the child, simply, as a number, as a dependent being and makes his familiar and social reinsertion more difficult.
